Terms of Service
1. Acceptance of Terms
By accessing or using Setup Scanner ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and subscribers.
2. Description of Service
Setup Scanner is a web-based technical analysis platform that scans US equities using technical indicators across multiple timeframes and surfaces potential day and swing trade setups. The Service is provided on a subscription basis with a free tier and a paid Pro tier.
Market data is sourced from third-party providers (currently Alpaca Markets). We do not guarantee the accuracy, completeness, or timeliness of any data. Market data may be delayed, incomplete, or subject to errors beyond our control.
3. No Financial Advice
Setup Scanner provides technical analysis signals for informational and educational purposes only. We are not a registered investment advisor, broker-dealer, or financial institution. Nothing on this platform should be construed as:
- A recommendation to buy, sell, or hold any security
- Financial, investment, tax, or legal advice
- A guarantee of any particular outcome or return
Past signals do not guarantee future results. Always conduct your own research and consult a qualified financial professional before making any investment decisions.
4. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.
5. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@setupscan.app if you suspect unauthorized access to your account.
You may not share your account with others or create multiple accounts to circumvent free tier limitations. We reserve the right to suspend or terminate accounts that violate these Terms.
6. Subscriptions and Billing
Setup Scanner offers a free tier and a paid Pro plan billed at $10.00 per month. Subscriptions are processed through Stripe and renew automatically at the end of each billing period.
- Cancellation: You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period; you retain Pro access until then.
- Refunds: All payments are non-refundable except where required by applicable law. We do not issue prorated refunds for partial billing periods.
- Price changes: We reserve the right to change subscription pricing. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.
- Failed payments: If a payment fails, your account may be downgraded to the free tier until payment is resolved.
7. Free Tier Limitations
Free tier accounts are subject to the following limitations, which may change at our discretion:
- Maximum of 20 tickers per scan
- Single timeframe analysis
- Manual scans only (no auto-scan scheduler)
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulation
- Scrape, crawl, or systematically extract data from the Service
- Attempt to reverse engineer, decompile, or access non-public portions of the platform
- Resell, sublicense, or commercially redistribute scan results or signals without our written consent
- Interfere with or disrupt the integrity or performance of the Service
- Use automated means (bots, scripts) to interact with the Service beyond normal use
9. Intellectual Property
The Service, including its code, design, scan algorithms, and all content, is owned by Setup Scanner and protected by applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.
You retain ownership of any watchlists, configurations, or data you input into the Service.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF DATA, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or reliability of any scan results or signals.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SETUP SCANNER AND ITS OWNERS, OPERATORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Trading or investment losses of any kind
- Loss of profits, data, or business opportunities
- Damages arising from reliance on scan results or signals
- Service interruptions or data inaccuracies
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $10.00, WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify and hold harmless Setup Scanner and its owners, operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.
You may terminate your account at any time by canceling your subscription and ceasing use of the Service.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the effective date above and, where appropriate, by email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be resolved in the applicable courts of competent jurisdiction. You waive any objection to the exercise of jurisdiction over you by such courts.
